What performers are eligible for Accident on Set benefits?

As a performer who was injured on a set location on an insured production, you may be eligible for Accident on Set benefits if you’re a Member of ACTRA as defined under either ACTRA Agreements or the British Columbia Master Production Agreement (BCMPA). This includes:

Means any person as defined under the ACTRA Agreements or BC Master Agreement. Performer includes, without limitation, the following:

a) Members and apprentice members, including stunt performers, Stunt Coordinators and other stunt categories as well as stand-ins, photo-doubles, special background performers and background performers;

b) Permittees when ACTRA has agreed to their engagement under an ACTRA contract through the issuance of an ACTRA work permit. Permittees who normally reside outside of Canada are only eligible for coverage under the Accident on Set Program while working in Canada and provided that premium is remitted on their behalf;

c) Additional background performers, engaged by the Producer and where an ACTRA Additional Background Performer Voucher has been issued to ACTRA.

Do all Canadian sets offer Accident on Set coverage?

No. Some provinces and territories already provide workers’ compensation coverage, so Accident on Set coverage is not required. Nevertheless, even in those provinces and territories with workers’ compensation, not all productions and performers are covered.

Please confirm with your ACTRA representative what type of insurance coverage has been put in place for your production.

I have insurance with AFBS through the Members’ Insurance Program, where do I make claims if I also have Accident on Set coverage?

If you are an active AFBS Member with coverage through the Members’ Insurance Program at Bronze Level or higher, you may be eligible for some coverage under that program. Contact AFBS to learn more.

I don’t reside in Canada; am I eligible?

Performers who do not normally reside in Canada are only covered for Accident on Set benefits while they are working in Canada.

Because our program is meant to supplement the publicly funded plan and public health care systems are different in every country, the Accident on Set insurance program may not cover every need expected by a non-resident performer. For this reason, non-resident performers should have their own Travel Emergency Medical coverage in place prior to leaving their home country.

Will Accident on Set replace any earnings from jobs I was unable to work due to my injury on a production insured under Accident on Set?

Accident on Set does not cover ACTRA specific earnings for jobs not carried out or completed as determined by your ACTRA contract. Payment is based on your actual earnings from the past two years.

What if the Producer and I disagree on whether an accident has occurred at all, or about the nature, cause or severity of the injury?

Work with your ACTRA representative who can advocate for you with the production team and the Producer for the set on which you were injured. While the Producer is required to provide a report for all incidents, it does not mean that there will be a claim. Reporting an incident does not automatically result in a claim, but it allows Accident on Set staff to determine if a claim is eligible.

What if my Producer doesn’t fill out the form either on time or at all?

What are my options if I am too injured to advocate for myself?

Your ACTRA representative should be able to assist with managing the process.

Does Accident on Set impact my AFBS coverage?

No. While you do need to be an ACTRA Member in good standing to work on an ACTRA production, anything that occurs on set will not directly impact either your insurance or investments as administered by ABFS.

How is the amount of my Weekly Income Replacement Benefit (WIRB) determined?

Should you be eligible for WIRB, Accident on Set staff will reach out to you to determine your eligible income used for the calculation. In addition to your earnings from work with ACTRA jurisdiction which is reported to AFBS, we will include personal earnings from your work from other employment sources.

Note that business income is not considered personal earnings and will not be considered eligible income. For performers working under ACTRA jurisdiction through personal service corporations, gross earnings as reported by ACTRA will be used.

Please note that any government issued benefits, pensions, bursaries, grants and honoraria are not eligible to be considered as earnings.
